This bill amends existing Hawaii law concerning condominiums to prohibit condominium associations from charging unit owners attorneys' fees related to fines unless those fines are deemed collectable, which occurs if an appeal period expires without an appeal, a fine is upheld after an appeal and no small claims action is filed, or a small claims court doesn't invalidate the fine within ninety days of a timely filed action. Additionally, the bill allows a court to assess costs, expenses, and attorneys' fees against a party who requests a trial de novo, which is a new trial held after an initial arbitration or court proceeding, if that party fails to improve their position by at least thirty percent compared to the original arbitration award.
