This bill, effective July 1, 2026, authorizes the use of hemp and hemp-derived feed ingredients in commercial animal feeds for pets, specialty pets (which are household animals like rodents, ornamental fish, reptiles, ferrets, and rabbits not raised for food), and horses, provided these ingredients are registered, sourced legally, and comply with specific limits on tetrahydrocannabinol (THC), contaminants, and good manufacturing practices as outlined by the Department of Agriculture and Biosecurity. For livestock feed, the use of hemp or hemp-derived ingredients is contingent on approval by the United States Food and Drug Administration (FDA) or a definition in the official publication of the Association of American Feed Control Officials (AAFCO), a non-profit organization that develops model regulations for animal feed. The bill also requires manufacturers and distributors to maintain records and provide samples for testing, clarifies that it does not authorize the use of cannabinoids like cannabidiol (CBD) in feed unless expressly permitted by federal law, and prohibits their use in human food, beverages, or cosmetics. The Department of Agriculture and Biosecurity is mandated to adopt rules to implement these provisions, including those for ingredient registration, testing, labeling, recordkeeping, and enforcement, and must initiate rulemaking by December 31, 2026, to recognize any hemp-derived feed ingredients defined by AAFCO.
