Bill Summary

Requires certain wastewater treatment works to test sewage sludge and any other residual material for the presence of PFAS. Requires the Department of Health to adopt administrative rules for the monitoring, sampling, testing, and data collection of sewage sludge and other residual material that contain specific amounts of PFAS. Prohibits the issuance or renewal of permits if testing yields PFAS in sewage sludge or other residual material on land used for agronomic purposes, on land where drainage tiles have been installed, on land that drains into waters of the State, or land in a 500-year floodplain. (SD1)

AI Summary

This bill requires wastewater treatment works that apply sewage sludge to land to test this sludge and any other residual material for perfluoroalkyl and polyfluoroalkyl substances, commonly known as PFAS, which are a group of man-made chemicals. The Department of Health will establish rules for how this monitoring, sampling, testing, and data collection should be conducted. Importantly, permits for land application of this material will not be issued or renewed if PFAS are detected in the sewage sludge or residual material when it is intended for use on land for growing crops, land with drainage tiles, land that drains into state waters, or land within a 500-year floodplain, which is an area with a 0.2% chance of flooding in any given year.
