This bill prohibits the sale, barter, or donation of any item or material that is infested with a pest, is itself a pest, or is otherwise prohibited from public availability under existing laws, with exceptions for items used for research or containing permitted biocontrol agents. The Department of Agriculture and Biosecurity is authorized to quarantine, treat, or destroy such pest-infested items at the owner's expense, and penalties are established for violations, including fines that increase for repeat offenses. This legislation aims to prevent the spread of invasive species, which are often introduced through the transportation of plants and merchandise, by regulating items sold to the public and empowering the department to take action against infested materials.
