This bill modifies existing laws regarding hospital inspections in Washington State, primarily by updating the frequency and conditions under which these inspections occur. The Department of Health will continue to conduct unannounced inspections of all hospitals, but the bill clarifies that these inspections will happen at least every 18 months, a change from previous language that suggested an average frequency. Importantly, the bill introduces provisions allowing the Department to temporarily pause inspections during declared federal, state, or local emergencies if it determines that continuing inspections would not be in the best interest of public health, though this does not prevent investigations into patient well-being concerns. Furthermore, hospitals that undergo surveys for certification by the federal Centers for Medicare and Medicaid Services (CMS) or by an approved accrediting body may be deemed equivalent to a Department survey, potentially extending their inspection frequency to every 36 months if the survey standards are substantially equivalent to the Department's. The bill also refines the conditions under which a hospital's noncompliance with fire protection standards can lead to reinspection, specifying that reinspection may occur if the noncompliance constitutes "immediate jeopardy" or a "condition-level violation," which is defined as a deficiency that doesn't pose an immediate threat but limits the hospital's ability to provide safe care.
