This bill expands the definition of a "person" who can be the subject of a wrongful death lawsuit to include an unborn child from the moment of fertilization, not just when it is in the womb, and it also extends the timeframe from two to three years after which a surviving spouse is presumed to have abandoned their deceased spouse, meaning they might lose their right to bring a wrongful death claim if they have willfully withdrawn from the deceased spouse's life for that period. A wrongful death action is a lawsuit brought by surviving family members when someone dies due to the negligence or wrongful act of another.
