AI Summary

This bill, known as the "Essential Services for Renters Act," amends Georgia law to provide renters with more rights regarding necessary repairs in their homes. It defines "essential service" as critical utilities like plumbing, electricity, gas, HVAC, and hot/cold water, and "necessary repair" as any defect affecting these services or the habitability of the dwelling. If a landlord fails to make a necessary repair within 14 days of receiving written notice, the tenant can arrange for the repair themselves, using a licensed professional approved by the landlord or any licensed professional if none is specified. The tenant can then deduct the reasonable cost of the repair from their next rent payment, provided they submit receipts, and can continue to do so for subsequent rent payments if the cost exceeds one month's rent. If a landlord still fails to make a necessary repair within 60 days of notice, and the tenant has not already undertaken the repair, the tenant can terminate their lease after giving the landlord 30 days' written notice. These provisions do not apply if the tenant caused the damage. The act also clarifies that rental agreements inherently include a provision that the premises are fit for human habitation, including compliance with health and safety codes, and will take effect for rental agreements entered into or renewed on or after July 1, 2026.
