This bill requires that, before January 1, 2028, any renewable energy source that produces measurable carbon dioxide emissions and is overseen by the Clean Air Branch of the Department of Health must install and operate a continuous monitoring system in each smokestack to measure carbon dioxide emissions. Furthermore, starting January 1, 2028, to qualify for the state's renewable portfolio standard, which mandates that electric utilities source a certain percentage of their electricity from renewable sources, these renewable energy sources will need to meet specific carbon dioxide emissions rate standards, with an average annual rate below one thousand five hundred pounds per megawatt hour. The bill also clarifies that by January 1, 2045, any energy generating facility emitting carbon dioxide from a point source regulated by the Clean Air Branch will no longer be considered a renewable energy source for the purpose of meeting these standards, all in an effort to support the state's broader goals of achieving zero emissions across all transportation sectors by 2045, as influenced by a recent court settlement.
