This bill directs the State Corporation Commission to study the effects of limiting the use of Tier 2 generators, which are a type of emergency generator, at data centers. Specifically, the Commission must assess how restricting Tier 2 generators to only sudden, unexpected power outages, and not planned ones, would impact the environment and finances. It also requires the Commission to consider if data centers should be mandated to upgrade at least 20% of their Tier 2 generators each year for five years to meet or exceed the emissions standards of Tier 4 equivalent or better generators, which are more environmentally friendly. The study will also look at what other states are doing to regulate generators in data centers and how generators are used in other sectors within Virginia, like hospitals and universities. The findings of this evaluation will be reported to legislative committees by October 15, 2026.
