This resolution directs the Joint Legislative Audit and Review Commission (JLARC), a state agency that conducts performance audits and program evaluations, to study the potential impacts of expanding discretionary parole eligibility. Discretionary parole is a system where incarcerated individuals can be released before the end of their sentence based on the judgment of a parole board, as opposed to mandatory parole which is automatically granted when certain conditions are met. The study will involve consulting with various state agencies and stakeholders, including the Virginia Parole Board and the Department of Corrections, to analyze current parole eligibility, assess staffing and resource needs for expanded parole, examine recidivism rates of those currently granted conditional geriatric release, and evaluate the fiscal impact of limiting parole. JLARC will also research successful parole policies in other states, develop recommendations for a risk assessment tool to evaluate release candidates, and identify methodologies for future parole expansion. The commission is required to hold its first year of meetings by September 1, 2026, submit an interim report by March 1, 2027, and complete its second year of meetings and submit its final findings and recommendations by December 1, 2027, with all relevant state agencies mandated to provide assistance.
