This bill extends the statute of limitations for legal actions related to medical injuries arising from gender reassignment surgeries, gender-altering medications, or other gender transition services, allowing claims to be brought within 20 years of discovering both the injury and its cause, and importantly, revives previously time-barred claims. It also clarifies that any attempt by an injured party to waive their right to sue for such medical professional liability is void and against public policy, and specifies that certain existing legal provisions (§55-7B-6 and §55-7B-8) do not apply to these types of medical injury claims, while also allowing for additional damages, including costs for subsequent treatments related to the initial procedure or prescription.
