This bill amends West Virginia law to require drivers to stay in the rightmost lane of roadways with two or more lanes of traffic moving in the same direction, unless specific exceptions apply. These exceptions include passing another vehicle, when traffic congestion makes it impractical to stay right, during inclement weather that makes the left lane safer, when there are obstructions or hazards in the right lane, when highway design requires using the left lane to prepare for an exit, when a law or traffic control device necessitates using the left lane, for commercial drivers unable to safely move right due to highway grade or being passed on the right, when paying tolls, or when moving left to allow merging traffic. The bill also clarifies that these provisions do not apply to emergency vehicles or those involved in highway maintenance and construction, and it does not limit the Department of Transportation's authority to set lane restrictions. Importantly, enforcement of this new left-lane rule for passenger vehicles can only occur as a secondary action if the driver is stopped for another traffic violation.
