Bill Summary

Certain data from water users; water use consumption of data centers. Requires any water user that (i) provides water to a data center, as defined in relevant law, with an air permit issued by the Department of Environmental Quality and (ii) is required to register certain water withdrawal and use data with the State Water Control Board to report to the Board the total volume of water, including the portion that is reclaimed water, provided during each month to a data center during the reporting period. The bill provides that if water provided to a data center is not measured on a monthly basis, the amount provided during each quarter shall be provided to the Board.

AI Summary

This bill requires any entity that supplies water to a data center and is already mandated to report water withdrawal and usage data to the State Water Control Board to also report the total volume of water, including any reclaimed water, provided to that data center on a monthly basis, or quarterly if monthly measurements are not feasible. This new reporting requirement is intended to provide more detailed information on water consumption by data centers, which are defined in the bill by referencing a section of the tax code related to their air permits. The bill also specifies that these new provisions will take effect on January 1, 2027.
