This bill mandates that any new construction or significant expansion, defined as increasing the building's footprint by over 10%, of a data center—a facility primarily for storing, managing, and processing digital data and housing related infrastructure like servers, cooling systems, and power equipment—must incorporate a rainwater harvesting system. This system must be capable of collecting rainwater runoff from at least 30% of the data center's total roof area and this collected rainwater must be used for non-potable water needs, meaning water not intended for human consumption, such as irrigation or cooling equipment. Furthermore, these rainwater harvesting systems must be designed, installed, and regularly inspected by individuals certified by the American Society of Sanitary Engineering, and the State Board of Health, in conjunction with the Department of Environmental Quality, is authorized to create necessary regulations to implement these requirements.
