AI Summary

This bill, known as the Artificial Intelligence Fraud and Accountability Act, establishes legal recourse for individuals and entities harmed by deceptive uses of artificial intelligence (AI). It defines "artificial intelligence fraud" as using AI systems, which include technologies like deepfakes, voice cloning, generative text or image tools, chatbots, or automated decision-making systems, to trick, impersonate, or steal from others. Those who suffer losses due to such fraud can sue for damages, including either actual losses or a statutory amount of $500 per violation, whichever is greater, and can also recover legal fees. If a court finds that the violation was knowing and willful, it can award punitive damages, which are intended to punish the wrongdoer. Furthermore, individuals or entities affected by AI fraud can seek court orders, known as injunctions, to stop the fraudulent activities, and these injunctions can be temporary or permanent and are issued without requiring the filer to post a bond. The bill also states that anyone who knowingly creates, uses, or helps facilitate AI systems for fraudulent purposes can be held equally responsible for any resulting damages.
