This bill establishes a pilot program allowing the department of commerce to advance funds to eligible public benefit nonprofit corporations, which are organizations established for charitable or public purposes, to help them perform work required by grants they have received. To qualify, nonprofits must have been awarded a grant within the last six months, have a history of satisfactory performance, have been in operation for at least three years for the grant's purpose, and the grant must be for public health, safety, welfare, or a state benefit. The advance payment is a one-time amount, limited to 25% of the grant or $200,000, whichever is less, and will be deducted from the total grant amount. The department will develop procedures for demonstrating need and eligibility criteria, prioritizing smaller nonprofits with annual budgets under $5 million. An enforceable contract must be in place before any advance funds are disbursed, and these funds can only be used for the contract's stated purpose. The department will report on the program's outcomes and provide recommendations by September 1, 2028, and the pilot program will expire on June 30, 2029. This bill also amends existing law to explicitly authorize the department of commerce to make these advance fund payments to nonprofits under an approved contract.
