This bill requires prosecuting attorneys, before sending a "Giglio letter" or adding an officer to a "Giglio list," to first notify the law enforcement officer in writing about the potential action and the reasons behind it. A "Giglio letter" or "Giglio notification" is defined as communication from a prosecutor to an officer's employer stating that the officer may not be credible to testify in court due to issues like untruthfulness or misconduct. A "Giglio list" or "Brady-Giglio list" is a compilation of officers whose credibility is questioned to the point they may not be called to testify. The bill mandates that prosecutors must provide officers with an opportunity to review relevant evidence, present their case, and meet with the prosecutor, with the right to have legal counsel present. If the prosecutor still decides to issue a Giglio letter or add the officer to the list, the officer has the right to appeal this decision to the chancery court in their county of residence for a new review of the case.
