This bill, known as the "Ending Agency Overreach Act," aims to curb the power of state administrative agencies by establishing new legal standards for how their actions are reviewed and challenged. Specifically, it mandates that when a court reviews an agency's decision on appeal, it must interpret the relevant statute or agency rule or regulation from scratch, without giving deference to the agency's own interpretation, and any ambiguity will be resolved against expanding the agency's authority. Furthermore, the bill requires that civil penalties cannot be awarded against individuals or entities for actions that could also be the subject of a lawsuit where a jury trial is guaranteed, unless a jury trial has actually occurred in a circuit, county, or chancery court, with some exceptions for existing chancery court cases and summary judgments. Finally, it extends the timeframe for contesting the validity of an agency rule, allowing individuals or entities to challenge a rule up to one year after they are harmed by a final agency action, or one year after the rule's effective date, whichever is later.
