This bill creates new offenses and penalties for vape shops and their distributors, wholesalers, or importers, as well as manufacturers, regarding the sale of Kratom and nitrous oxide. Kratom is defined as either the natural leaf or powder form, or synthetic versions containing specific compounds, while nitrous oxide is identified as N2O, also known as laughing gas. A vape shop is defined as a business primarily selling electronic smoking devices and related products, and a vape shop retailer is anyone engaged in selling these items, including Kratom and nitrous oxide. The bill makes it illegal for these entities to sell Kratom or nitrous oxide for retail sale in Tennessee, with escalating civil penalties for repeat violations, including fines, license suspension, and revocation. Manufacturers knowingly causing these products to be sold face a significant civil penalty. Repeated violations are also considered deceptive trade practices. The bill takes effect on July 1, 2026.
