A data center is defined as a facility primarily used for housing servers and data storage systems, potentially with backup power and cooling infrastructure. The bill also requires these reports to include information on waste heat production and recovery, as well as projected future energy and water demands. The Department of Environmental Protection, in consultation with the Pennsylvania Public Utility Commission, will then publish an annual report summarizing these trends, environmental impacts, and recommendations, making aggregated and anonymized data publicly available while protecting proprietary information. Failure to comply with these reporting requirements will result in a civil penalty of $10,000 per day until the report is submitted, with collected penalties going to a low-income electric customer assistance program.
