This bill, known as the Data Center Energy and Water Reporting Act, mandates that data centers in Pennsylvania, defined as facilities with a peak electric demand of 10 megawatts or greater that house servers and have cooling systems, must submit annual reports to the Department of Environmental Protection. These reports, due by July 1st each year starting in 2027, will detail the facility's total energy and water consumption from the previous year, including sources, monthly usage, and any efficiency measures taken, as well as projected future demand. The Department, in consultation with the Pennsylvania Public Utility Commission, will then publish a public report on data center consumption trends and environmental impacts. Failure to comply with these reporting requirements will result in a civil penalty of $10,000 per day, with collected penalties going to low-income electric customer assistance programs.
