This bill amends existing Nebraska law regarding liens that arise from child and spousal support orders. Specifically, it clarifies that a judgment or order for child or spousal support automatically creates a lien on the debtor's real or personal property that attaches when a payment is due and is extinguished when the payment is made. To prove that payments are current and to release a lien for the purpose of transferring property, a payment history from the Title IV-D Division of the Department of Health and Human Services showing twelve months of on-time payments (or the duration of the order if shorter) will serve as prima facie evidence, meaning it's accepted as sufficient proof unless proven otherwise. The bill also maintains provisions for releasing or subordinating these liens and outlines procedures for court intervention if a judgment creditor refuses to do so without good reason.
