This bill allows the Commissioner of Health to petition a circuit court to appoint a receiver for any public or private waterworks that is unable or unwilling to provide adequate and safe service due to issues such as failing to provide pure water, having inadequate capacity, not complying with the Commissioner's orders, being abandoned by the owner, facing a forfeiture order, or posing an imminent danger to public health and welfare. A receiver, who acts as an officer of the court, would then take possession of the waterworks' assets and operate it in the best interest of the customers, with the court determining the receiver's powers and duties until the waterworks can be returned to the owner, transferred, or otherwise managed as the court deems appropriate. This provision currently only applies to private waterworks, and this bill seeks to expand it to include public waterworks as well.
