This bill establishes new rules for how local governments in Tennessee can relocate homeless individuals, aiming to prevent them from simply moving homeless populations to other areas without proper planning. Specifically, it prohibits a local governmental entity, which refers to a city or county government, from relocating a homeless person to another jurisdiction unless that receiving jurisdiction has given its written consent. Furthermore, local governments are forbidden from using public funds to move homeless individuals to other areas unless they can confirm that housing and other essential services are actually available for those individuals in the new location. To enforce these provisions, the bill authorizes the attorney general and reporter, Tennessee's chief legal officer, to pursue civil penalties of up to $10,000 for each instance a local government violates these relocation rules. Additionally, any jurisdiction negatively impacted by such a violation can sue the offending local government for damages and to obtain court orders to stop the practice.
