Bill Summary
Duties and responsibilities of local pretrial services officers; assessments. Requires a local pretrial services officer to conduct a risk assessment of defendants arrested on state and local warrants and who are detained in jails located in jurisdictions served by the local pretrial services agency while awaiting a hearing before any court that is considering or reconsidering bail, at initial appearance, advisement or arraignment, or at other subsequent hearings. Current law requires a local pretrial services officer to interview such defendants. The bill also provides that each local pretrial services officer may conduct defendant interviews as appropriate and when available resources permit.
AI Summary
This bill requires local pretrial services officers to conduct a risk assessment of defendants arrested on state and local warrants who are detained in jails within the jurisdictions they serve and are awaiting court hearings related to bail, initial appearance, advisement, arraignment, or other subsequent hearings, replacing the current requirement for these officers to merely interview such defendants. Pretrial services officers are responsible for investigating and assessing defendants to help courts make decisions about bail, supervising defendants on pretrial release to ensure they follow court orders, conducting drug and alcohol testing when ordered, and seeking warrants for defendants who violate their conditions or pose a risk. The bill also outlines optional services these officers can provide, such as conducting drug and alcohol screenings, facilitating placement in treatment programs, supervising defendants on home electronic monitoring, and assisting with financial eligibility for indigent defense services.
