This bill amends Tennessee Code Annotated, Title 39, concerning contraband in penal institutions, by removing a limitation on the penalty for illegally possessing a telecommunication device, such as a cell phone, within a prison or jail. Previously, a violation of this law was classified as a Class E felony, but the penalty was restricted to a fine only, meaning no jail time could be imposed. This bill changes that by allowing for the full range of penalties associated with a Class E felony to be applied, which could include imprisonment in addition to or instead of a fine.
