This bill amends existing Kentucky law to allow local public agencies to purchase used vehicles and equipment without competitive bidding under certain conditions. Specifically, agencies can use a noncompetitive negotiation process if the purchase price for used vehicles or equipment does not exceed 75% of the manufacturer's suggested retail price for a new, similar item. This change is being made to KRS 45A.380, which outlines when noncompetitive negotiation is permissible, and to KRS 424.260, which generally requires local agencies to advertise for bids for purchases over $40,000. The amendment to KRS 424.260 also clarifies that newspaper advertisements for bids are not required for these specific used vehicle and equipment purchases.
