This bill establishes a new legal mechanism in Washington State for transferring vehicle ownership upon death, known as a "transfer on death title." This allows a vehicle owner, or joint owners, to designate a "beneficiary" who will automatically receive the vehicle upon the owner's death, without the need for probate or other formal legal proceedings. The transfer is effective at the time of the owner's death and does not require the beneficiary's consent or knowledge during the owner's lifetime. The owner retains full control of the vehicle during their life and can revoke the transfer on death designation at any time by selling the vehicle or obtaining a new title without a designated beneficiary. If the designated beneficiary does not survive the owner or disclaims the interest, the vehicle will be included in the owner's estate. The bill also makes conforming amendments to existing laws regarding definitions of "nonprobate asset" and procedures for transferring vehicle titles, ensuring that these "transfer on death titles" are recognized and properly handled by the Department of Licensing and other relevant authorities.
