This bill prohibits businesses, referred to as "entities," from using personalized algorithmic pricing to set the price of goods or services for consumers in Tennessee. Personalized algorithmic pricing is defined as dynamic pricing, meaning prices that change based on conditions, which is determined by an algorithm (a set of automated rules) that uses personal data. Personal data is broadly defined as any information that can identify or be linked to a specific consumer or device, with some exceptions for location data used for ride-sharing fares. Violating this prohibition is considered an unfair or deceptive business practice under the Tennessee Consumer Protection Act of 1977, which can lead to penalties and remedies. However, this prohibition does not apply to entities regulated by insurance laws, financial institutions subject to federal privacy laws, certain banking and lending institutions, or prices offered to consumers with existing subscription contracts that are lower than the contract price. The bill takes effect on July 1, 2026.
