This bill establishes provisions for community solar gardens, which are solar facilities that generate electricity and provide bill credits to subscribers to offset their electricity bills. A community solar facility is defined as a solar photovoltaic device located within the state, connected to the distribution system, with a capacity between 100 and 5,000 kilowatts, and at least ten subscribers. Subscribers are retail customers who own a portion of a community solar facility or have a contract (subscription) entitling them to bill credits. The bill mandates that each retail electric supplier, which includes municipal utilities, electrical corporations, and rural electric cooperatives, implement a three-year community solar pilot program from 2027 to 2029, aiming for subscribers to represent two percent of the supplier's electricity sales annually. The program allows third-party entities to own or operate these facilities and administer bill credits, with the price of subscriptions generally not subject to regulation. However, the Public Service Commission (PSC) will determine the value of bill credits, ensuring they facilitate the creation and operation of these facilities and provide savings for low-income customers, who must constitute at least ten percent of subscribers, with residential customers making up at least twenty percent. Retail electric suppliers will process these bill credits and can be compensated for interconnection costs and other compliance expenses through fees paid by subscriber administrators. The bill also addresses the purchase of any electricity not allocated to subscribers, known as "unsubscribed energy," at the supplier's avoided cost, and requires the PSC to establish rules for interconnection standards and net metering for these facilities.
