This bill, known as the Access & Responsible Digital Safety Act, establishes rules for app developers and app distribution providers (app stores) to protect minors online by requiring them to implement measures related to age appropriateness for software applications, or "apps," which are programs designed for connected devices like smartphones and tablets and distributed through app stores. App store operators must ask users for their age when creating an account and provide developers with the technical ability to access an "age signal," which is information about a user's age category that the user or their parent has agreed to share, allowing app stores to prevent minors from accessing or using "covered applications" – apps that offer different experiences for adults and minors or are intended only for adults. Developers of these covered applications must report their age-specific features, provide tools to help parents supervise minors, make reasonable efforts to determine a user's age, and obtain parental consent before minors can access content or features deemed unsuitable for them without supervision, while also being prohibited from delivering advertising to minors. The bill also clarifies that app store operators and developers who make good-faith efforts to comply with these age verification and protection measures will not be held liable for errors in age signals or for the conduct of the other party, and it grants the Attorney General exclusive authority to enforce these provisions, with civil penalties of up to $1,000 per violation, and explicitly states that this act does not create a basis for private lawsuits.
