This bill authorizes the governing bodies of the City of Greenwood and Leflore County to sell or lease Greenwood Leflore Hospital, including its property and assets, to any individual, partnership, corporation, or another community hospital owner, provided certain conditions are met. These conditions include complying with existing laws on selling community hospitals unless this bill specifies otherwise, conducting a competitive bidding process where all hospital assets and liabilities are disclosed, completing the transaction within one year, and the current owners relinquishing all rights. The new owners will be responsible for all hospital debts, including repaying overpayments from the Mississippi Access Hospital Program (MHAP) to the Division of Medicaid, must continue to operate the Rural Community Hospital Demonstration Program if eligible, maintain an emergency room, and keep the swing-bed program operational. This bill will only become effective after the Legislature passes separate legislation that delays the recoupment of MHAP overpayments until 2027, allows for an installment repayment plan for these overpayments, and appropriates at least $10 million to the new hospital owners for operational purposes, contingent on agreement from both the current owners and the new owners. The bill also includes existing language from Section 41-13-15 of the Mississippi Code of 1972, which outlines general provisions for the acquisition, construction, operation, sale, and lease of community hospitals by counties and municipalities.
