This bill prohibits the use of state or local funds for postsecondary education programs that are identified as "low-earning outcome programs," which are defined by federal law (specifically, 20 U.S.C. 1087d) as programs where graduates do not earn enough to justify the cost of their education. This prohibition applies to all forms of funding, including individual student financial aid, operational and instructional budgets, specific grants, and funding for buildings and facilities. The Nebraska Coordinating Commission for Postsecondary Education is tasked with annually reviewing these federal determinations, enforcing the funding ban, and reporting to the Legislature on the federal classifications, how the ban is being enforced, and its estimated financial impact. The Commission is also empowered to create rules and regulations to implement these provisions.
