This bill expands existing laws to prohibit individuals subject to certain domestic violence protection orders from possessing or purchasing firearms, and also prohibits those convicted of misdemeanor domestic violence offenses or stalking from possessing firearms. Specifically, if a court issues a full order of protection after a hearing where the respondent had notice and an opportunity to participate, the court can now prohibit the respondent from knowingly possessing or purchasing any firearm while the order is in effect, and this prohibition will be communicated to the respondent and reported to the Missouri State Highway Patrol to update the National Instant Criminal Background Check System (NICS). Furthermore, the bill clarifies that individuals convicted of misdemeanor domestic violence, such as domestic assault in the fourth degree or stalking in the second degree, or those subject to a domestic violence protection order issued after a hearing, are prohibited from possessing a firearm, with "domestic violence" and "family or household member" being defined for these purposes. The bill also mandates that convictions for domestic assault in the fourth degree and stalking in the second degree be reported to the Missouri State Highway Patrol for NICS updates.
