This bill, known as the Political Subdivision Contracting Transparency Act, aims to improve how local government entities (political subdivisions) handle contracts for goods, services, or construction, and it will expire on July 1, 2030. It defines key terms like "contracting agency" (a political subdivision involved in buying things), "prime contractor" (the main company hired by the agency), and "subcontractor" (a company hired by the prime contractor). The act mandates that contracting agencies pay prime contractors within thirty days of receiving an accepted invoice, and prime contractors must then pay their subcontractors within seven days of receiving payment from the agency, with interest accruing on any late payments. It also requires contracting agencies to provide a post-award debriefing to unsuccessful bidders within ten business days of a request, outlining evaluation criteria, bid strengths and weaknesses, and compliance issues, unless proprietary information or active litigation prevents it. Furthermore, the Department of Administrative Services will create a public online procurement calendar for all solicitations over $50,000, requiring agencies to post solicitations at least fourteen days before the due date, including details like the scope of work and contact information. The Department of Economic Development will also develop a checklist to help small businesses prepare for public contracts, including information on required registrations, insurance, and the availability of a "mobilization micro-advance," which is a financial tool to help small businesses start work on awarded contracts. Finally, the Urban Affairs Committee will review the act in 2029 to recommend whether it should continue, be changed, or expanded.
