This bill, relating to the punishment of persons with illegal immigration status, establishes penalties for individuals found to be in the country illegally within West Virginia. Specifically, if local, state, or federal law enforcement determines an individual is in the country illegally, they will be immediately handed over to Immigration and Customs Enforcement (ICE) for deportation. For a second offense, where the same individual is again found to be in the country illegally by law enforcement in the state, they will be charged with a felony, facing a prison sentence of three to five years in a state penitentiary, after which they will again be turned over to ICE for deportation. The bill also states that existing laws regarding immigration enforcement, referenced as §15-16-1 et seq., will apply, and no state or local entity or law enforcement agency can override this article or federal immigration policy.
