Bill Summary

A BILL FOR AN ACT relating to consumer protection; to adopt the Conversational Artificial Intelligence Safety Act; to provide powers and duties to the Attorney General; to provide civil penalties; and to provide an operative date.

AI Summary

This bill, known as the Conversational Artificial Intelligence Safety Act, establishes rules for companies that develop and offer artificial intelligence (AI) services that simulate human conversation to the public. An "operator" is defined as a company providing such a service, with exceptions for app stores and search engines that merely provide access. The act mandates that operators clearly inform users, especially minors (individuals under 18), when they are interacting with AI, either through a persistent disclaimer or regular notifications. For minor account holders, operators must prevent the AI from generating sexually explicit content or content that simulates romantic or adult-minor relationships, and they must also avoid making the AI claim sentience or simulate emotional dependence. Operators are required to provide tools for minors and their parents to manage privacy and account settings, and to have protocols for responding to users expressing suicidal ideation or self-harm by directing them to crisis services. Furthermore, operators cannot represent their AI as providing professional mental or behavioral healthcare. The Attorney General is empowered to enforce this act, with the ability to bring civil actions against operators for violations, seeking remedies such as damages, civil penalties ranging from $1,000 to $500,000 per operator, and recovery of legal expenses, though the act does not create a private right for individuals to sue. The bill also clarifies that developers of AI models are not liable for violations by third-party services using their models, and it will become effective on July 1, 2027.
