This bill, known as the "Oral Health and Cancer Rights Act," mandates that all health insurance plans must cover medically necessary dental and oral health procedures that are either required to undergo cancer treatment or are a direct result of such treatments, including surgery, chemotherapy, and radiation. This coverage extends to a wide range of services such as evaluations, examinations, patient education, laboratory tests, medications, treatments, restorations, rehabilitation, medical devices, and prosthetics, all aimed at restoring functions like eating, breathing, speaking, and swallowing that may be affected by cancer. To ensure proper billing and identification of these covered services, a specific billing modifier, "West Virginia Code §33-64-1," must be used with all applicable billing codes for these dental and oral health procedures, with a unique identifier used for qualifying medications. This act will take effect on July 1, 2027, and will apply to health insurance contracts that are not exempt from the Affordable Care Act, a federal law that sets minimum standards for health insurance.
