This bill, known as the Developmental Disabilities Provider Excessive Training and Cost Reduction Act, aims to prevent the Department of Health and Human Services (DHHS) from imposing overly expensive or unnecessary training mandates on employees of organizations or entities licensed to provide services to individuals with developmental disabilities. The act's purpose is to ensure that any training required by the DHHS is solely focused on protecting the health, safety, and well-being of those receiving services, and that these training requirements are appropriate, competitively priced, and meet federal standards. Specifically, the bill prohibits the DHHS from requiring all employees of providers to undergo training in the use of physical restraints unless their job duties might actually involve such actions, and it mandates that any required physical restraint training must not exceed federal minimum requirements. Furthermore, if physical restraint training is mandated, the DHHS must offer at least two cost-competitive training options, including allowing providers to use their own in-house programs if they meet federal safety and content standards. This act will apply to all training requirements for employees of providers, whether they are already in effect or are implemented, renewed, or enforced by the DHHS from the bill's effective date onward.
