This bill amends Tennessee law to designate records of the office of homeland security related to critical infrastructure as confidential, meaning they are exempt from public records requests. This includes records describing protected critical infrastructure facilities and critical infrastructure, as well as those involving the identification, analysis, prevention, and mitigation of acts of terrorism or criminal threats against such infrastructure. The bill also makes confidential records detailing vulnerability or security assessment information for specific locations, such as risk assessments, security plans, schematics, and cybersecurity configurations, though video footage of alleged crimes may be released after redaction to protect security information. Additionally, records concerning specific threat information related to terrorism, targeted violence, sabotage, or foreign adversary activity, as well as intelligence sharing with partners that reveals security capabilities or operational methods, will be kept confidential. The office of homeland security will be required to provide an annual report to the general assembly on threats against public officials. However, this confidentiality does not apply to investigations of alleged misconduct by law enforcement officers, excessive use of force, or violations of department policies, nor does it require redaction of information from judicial records. Basic information about arrests and crimes, including offense descriptions and incident narratives, will still be released unless otherwise confidential.
