Bill Summary

AN ACT amending title 16, chapter 4, article 1, Arizona Revised Statutes, by adding sections 16-407.04 and 16-407.05; relating to the conduct of elections.

AI Summary

This bill requires any individual or entity, excluding government bodies, that plans to provide money or in-kind goods and services for election administration to the government to first certify to the Secretary of State, at least ten business days in advance, that they are not knowingly receiving foreign donations, directly or indirectly. This certification must be sworn under penalty of perjury and updated annually or within five business days of receiving new information. The Secretary of State will maintain and publish these certifications online and will also require government entities to submit quarterly reports listing those who provide election administration resources. Failure to provide the certification or submitting an inaccurate one will invalidate any agreement with the government entity, and knowingly providing false information is a class 1 misdemeanor, a serious misdemeanor offense. Furthermore, the Attorney General can file lawsuits for knowing violations, seeking at least $5,000 in damages per violation, and any qualified voter or state officer can also bring civil actions to stop violations or enforce compliance, with prevailing claimants receiving injunctive relief, $1,000 per day in damages until compliance, and their court costs and attorney fees.
