Bill Summary

AN ACT to amend the county law and the correction law, in relation to establishing county law enforcement civilian complaint review boards

AI Summary

This bill requires each county, except for those wholly within a city, to establish a county law enforcement civilian complaint review board, referred to as a "review board," to assist the board of supervisors in thoroughly and impartially investigating complaints of misconduct by county law enforcement officials and officers, which includes all county law enforcement agencies and correctional facilities and their employees or contractors. This review board will be composed of seven appointed residents, who will receive a stipend, and may include ex-officio members from the public defender and district attorney's offices, with specific representation requirements including individuals with past incarceration, law enforcement experience, medical expertise, community advocacy, and chaplaincy experience, and prohibits current law enforcement officers from serving. The review board will have the power to establish its own rules, independently review complaints and internal investigations, access all relevant documents, make findings and recommendations on allegations of misconduct, and recommend policy changes to the board of supervisors, with provisions for timely decision-making and public disclosure of findings. Additionally, members of these newly established review boards will be granted the right to visit local correctional facilities within their county, alongside other designated officials.
