This bill modifies existing law to promote educational stability for children of military families by expanding the conditions under which they can meet residency requirements for school enrollment, allowing enrollment even if a parent is transferred to a military installation in a bordering state or if the family is relocating due to a military exigency requiring relocation, provided official military orders or documentation of the directed move are presented. It also extends the timeframe for providing proof of residence within the school district from fourteen days to ninety calendar days after enrollment, and allows for various forms of temporary lodging or housing arrangements as proof of residence, including temporary lodging facilities where permanent housing is expected. Furthermore, the bill permits school districts to accept enrollment applications and course registrations for these children electronically or by other means prior to their arrival in the state, with enrollment being finalized once all required documentation is provided. Importantly, if a transferring child has an individualized education program (IEP) or a plan developed under section 504 of the Rehabilitation Act of 1973, the school district must accept these records and ensure the child receives appropriate services and accommodations without unreasonable delay, with any necessary reevaluations to be completed within 30 calendar days of arrival, subject to parental consent. The bill clarifies that nonresident school districts are not obligated to provide transportation unless otherwise mandated by law.
