This bill establishes a producer responsibility program for mattresses in Washington state, aiming to increase recycling and reduce landfill waste. Producers of mattresses, meaning those who own the brand, manufacture, import, or first introduce them into the state, will be required to join or form a "producer responsibility organization" (PRO). These PROs, which are non-profit organizations, will develop and implement a comprehensive mattress stewardship program. This program will include plans for collecting discarded mattresses, educating the public, and ensuring environmentally sound management practices, with a goal of achieving at least a 70% recycling rate. Producers must register with the Department of Ecology through their PRO by July 1, 2027, and by January 1, 2031, only producers participating in an approved program can sell mattresses in the state. The bill also outlines registration requirements for PROs, including submitting plans, financial information, and annual reports, and establishes fees to fund the program and the department's oversight. Retailers will be responsible for selling only mattresses from registered producers and informing consumers about collection opportunities. The Department of Ecology will oversee the program, review plans, and can impose civil penalties for violations. An advisory council will be created to provide recommendations on plans and rules. Importantly, this legislation grants immunity from antitrust and trade practice laws to those involved in planning and operating the producer responsibility program.
