This bill, known as the TRACK ICE Act, amends existing law to limit the privacy protections available to aircraft operations conducted for immigration enforcement purposes. Specifically, it clarifies that private aircraft owners or operators involved in flights for U.S. Immigration and Customs Enforcement (ICE) or Customs and Border Protection (CBP) that are used for detaining, deporting, or transporting individuals in the custody of the Secretary of Homeland Security, and which receive federal funding, will not be eligible for programs that allow for the withholding of flight information. Furthermore, the bill mandates that the Department of Homeland Security, including ICE, CBP, and the Coast Guard, must publicly publish detailed flight data for such immigration enforcement operations within 72 hours, including departure and arrival times and locations, aircraft identification, the number of detainees transported, and demographic information about those detainees, along with details on any restraints used.
