This bill, known as the "Tennessee Private Workplace Due Process and Warrant Protection Act," establishes new protections for private businesses and their employees regarding immigration enforcement actions. It clarifies that state and local law enforcement agencies cannot assist federal immigration authorities in entering a private workplace, defined as any business location not open to the general public, unless those authorities present a judicial warrant, which is a warrant issued by a judge based on probable cause. The act explicitly states that administrative warrants or notices from federal immigration authorities are not sufficient for entry into a private workplace, and consent from an employee without authority over the premises is invalid. Business owners and employees are protected from penalties for refusing entry without a judicial warrant, and state agencies are prohibited from retaliating against businesses for exercising these rights. Furthermore, state and local agencies are forbidden from providing access to non-public business areas, employee records, or participating in questioning or detaining individuals for immigration enforcement without a judicial warrant. The Department of Labor and Workforce Development will create a notice informing businesses and employees of these rights, and evidence obtained in violation of this act will be inadmissible in state or local court proceedings, with businesses or individuals able to seek legal remedies for violations.
