This bill amends the Election Code to clarify and standardize provisions related to cybersecurity efforts for election authorities, which are local government bodies responsible for administering elections. Specifically, it aims to reconcile changes made by two previous public acts (P.A. 100-587 and P.A. 100-623) concerning the "cyber navigator program." This program is designed to help election authorities protect against and recover from cyberattacks. The bill mandates that the State Board of Elections adopt rules, following public hearings and consultation with election authorities, to establish this program. A key provision is that at least half of any federal funds received under the Help America Vote Act (a federal law providing funding for election administration) must be allocated to the cyber navigator program, which should offer equitable support to all election authorities, with some flexibility for differing needs. The remaining federal funds can be distributed by the Board as it deems appropriate, but only to election authorities that participate in the cyber navigator program. The bill also allows these remaining funds to be used for maintaining secure collection sites for vote-by-mail ballots.
