Bill Summary
Foreign divorce decrees; exercise of power by courts of the Commonwealth; non-domiciled party. Provides that a court of the Commonwealth with proper jurisdiction may exercise certain powers relating to a foreign decree dissolving a marriage or granting a divorce from the bond of matrimony if a proceeding is initiated by a non-domiciled party to such divorce, provided that the party domiciled in the Commonwealth is still domiciled in the Commonwealth at the commencement of an action.
AI Summary
This bill amends Virginia law to allow a court in the Commonwealth to exercise certain powers related to property and debts when a foreign country has granted a divorce. Specifically, if a person who was not living in Virginia when they got divorced elsewhere initiates a legal action in Virginia, the Virginia court can address property and debt matters, provided that the other party in the divorce is still living in Virginia when this new action begins. This change clarifies the circumstances under which Virginia courts can intervene in cases involving foreign divorce decrees, particularly when one party was not a resident of Virginia at the time of the foreign divorce but is now seeking resolution of financial matters within the Commonwealth.
