This bill directs the Joint Commission on Health Care to conduct a thorough study of how group homes and other facilities overseen by the Department of Behavioral Health and Developmental Services (DBHDS) are monitored and held accountable, including those participating in Medicaid developmental disabilities waiver programs. The study will examine the roles of other state agencies like the Department of Aging and Rehabilitative Services (DARS) and the Department of Social Services (DSS) in investigations, especially where their oversight responsibilities overlap with DBHDS. Key areas of review will include whether licensed providers investigating their own staff for abuse or neglect ensures fairness and transparency, how complaint and investigation data is handled, and what best practices from other states could be adopted. The Commission will also assess compliance with Medicaid and Home and Community-Based Services requirements and will report its findings and any proposed changes to state law or regulations to legislative committees by November 1, 2026.
