This bill prohibits the sale or distribution of beverages containing hemp, THC (tetrahydrocannabinol), or kratom, defining these as "prohibited beverages." A "hemp beverage" is any drink made from or containing parts of the hemp plant, including its natural compounds. A "THC beverage" includes drinks with various forms of THC, such as delta-8, delta-9, and delta-10 THC, as well as artificially derived cannabinoids. A "kratom beverage" is a drink made from kratom leaf or its extract, excluding synthesized alkaloids. Violators face misdemeanor charges with potential fines up to $500 or jail time up to three months. Retail food establishments and restaurants selling these prohibited beverages are subject to disciplinary actions, including license suspension or revocation, by the Department of Agriculture and Commerce and the State Department of Health, respectively. The bill also amends existing law to clarify that these new prohibitions do not permit the sale of kratom beverages that are already banned. The Department of Agriculture and Commerce and the State Department of Health are empowered to create necessary rules and regulations to implement these changes, which will take effect on July 1, 2026.
