Bill Summary

Law-enforcement agencies or localities; agreements with federal authority for certain immigration enforcement; limitations. Prohibits any state or local law-enforcement agency from maintaining, renewing, or entering into any federal immigration law-enforcement agreement unless such agreement contains certain conditions. The bill also prohibits any person acting in his capacity as a law-enforcement officer to assist or cooperate with or to allow or authorize any resources to assist or cooperate with or to otherwise facilitate any operation executed in whole or in part by federal authorities for the purpose of enforcing federal immigration law. The bill provides that such prohibition shall not apply where the authority to enforce such laws is otherwise permitted or required by state or federal law or where the person acting in his capacity as a law-enforcement officer is presented with a valid judicial warrant, judicial subpoena, or judicial detainer that authorizes such enforcement.

AI Summary

This bill, set to expire on June 30, 2028, establishes new regulations for law-enforcement agencies and localities in Virginia regarding agreements with federal authorities for immigration enforcement. It prohibits these entities from allowing their officers or employees to perform federal immigration functions unless a written agreement is in place that meets specific conditions. These conditions include requiring U.S. Immigration and Customs Enforcement (ICE) to provide advance notice of federal agents involved in immigration enforcement activities, mandating compliance with Virginia laws by federal agents, requiring clear identification of ICE agents without using the term "police," prohibiting immigration enforcement on school, faith-based, or courthouse property, and ensuring ICE agents consent to Virginia's court jurisdiction for violations. The bill also restricts ICE from making general information requests to state or local agencies and from requesting immigration status information without a judicial warrant or subpoena. Furthermore, it prohibits federal agents from conducting immigration enforcement within 500 yards of polling places during elections and restricts the use of certain surveillance technologies by ICE, with exceptions for individuals convicted of specific offenses. Any existing agreements must be modified to comply with these provisions by September 1, 2026, or they will be void. The bill also mandates that the State Police and local law-enforcement agencies collect data on whether federal immigration officers were present during investigatory stops and if they took any actions that would violate state law if committed by a non-federal official.
